Blue Cross Blue Shield Antitrust Litigation

Have you or your organization of fewer than 200 employees purchased insurance from Blue Cross and Blue Shield?

The Weiser Law Firm is investigating an anticompetitive scheme that has possibly been perpetrated by Blue Cross and Blue Shield, resulting in inflated health insurance premiums for residents of various states nationwide, including Kansas, New Hampshire, North Dakota, Iowa, Nebraska, Alaska and Indiana. The investigation is focused on whether 37 of the largest health insurance companies across the U.S., who operate regionally using the Blue Cross and Blue Shield brand name, illegally agreed: (a) that Blue Cross and Blue Shield would have the exclusive ability to sell Blue Cross and Blue Shield insurance in these states, and (b) Blue Cross and Blue Shield would not compete with any of the other Blue Cross and Blue Shield insurers in any of their exclusive territories. Any such agreement would be anticompetitive and in violation of federal antitrust laws, giving Blue Cross and Blue Shield monopoly power and the ability to set artificially inflated premiums to be charged to Blue Cross and Blue Shield customers.
